First revision of food safety law in five years

On June 23, the revised draft of food safety law was submitted to the ninth meeting of the Standing Committee of the 12th National People's Congress for deliberation. This is the first time since the current food safety law was promulgated and implemented in 2009, and it is revised for the first time in five years. The draft provides that the state strictly supervises and controls foods that claim to have specific health functions.

The current law only provides for health food in Article 51, pointing out that the state has "strict supervision" over it, but the specific measures shall be prescribed by the State Council; It is stipulated that health food shall not harm human body, claim to have disease prevention and treatment functions, shall contain information such as objects to be avoided, and ensure the authenticity of the description.

The revised draft is a relevant provision for health food from articles 65 to 68, and the text is large. The added contents include the establishment of "catalogue of substances that can be used for health food production but not for other food production", distinguishing health food which needs to be registered and only for filing, specifying the contents of materials and documents to be submitted for registration, etc.

Health food shall not cause acute, subacute or chronic harm to human body. Its label and instruction shall not involve disease prevention and treatment functions. The contents shall be true and scientific basis, and shall indicate suitable population, unsuitable population, efficacy component or symbolic component and its content, etc; The functions and components of the product shall be consistent with the label and instruction. The first imported health food shall be the product permitted to be marketed and sold by the competent department of the exporting country (region).

According to the new regulations, the use of new raw materials and the first imported health food needs to be registered with the food and drug regulatory department under the State Council, and the registrant and the filing person of health food are required to be responsible for the authenticity of the submitted materials. The special case is that "the safety and health functions of finished products and raw materials can pass the national standards The first imported health food which is evaluated by general requirements such as the specification ". Including the above exceptions, other types of health food only need to be recorded.
